Engagement Process
All engagement begins with case summary submission to privatecourtroom@proton.me. Summary must include: nature of matter, jurisdiction, timeline, consultation scope.
PCR evaluates submission for case fit. Evaluation criteria: evidentiary complexity, jurisdictional alignment, operational capacity. Response provided within 48 hours.
Not all cases accepted. Declined cases receive no further communication. Acceptance requires formal retainer agreement specifying scope, deliverables, fees, confidentiality obligations, and termination conditions.
Work commences upon signed retainer and payment of required retainer fee.
Payment Terms
All fees quoted and billed in USD. All fees are e-transferred within American and Canadian Jurisdictions.
Retainer required for accepted cases. Retainer amount specified in engagement agreement. Retainer is non-refundable upon commencement of work.
Billing structure determined by case complexity. Hourly rate or flat-fee arrangements specified in retainer agreement.
Invoices issued according to schedule defined in agreement. Payment due within 5 days of invoice date. Late payment results in work suspension until account current.
Failure to pay within 30 days of invoice date constitutes breach of agreement. Private Courtroom reserves right to terminate engagement and pursue collection.
Scope of Work
Services limited to scope defined in retainer agreement. Forensic analysis, behavioral assessment, expert witness preparation, testimony provided as specified.
Work product includes reports, data analysis, case reconstruction, expert testimony where requested. Deliverables specified in agreement.
Additional scope requests require written amendment to retainer agreement and additional fees.
Termination
Either party may terminate engagement with written notice. Termination effective upon receipt of notice.
Client termination: Fees owed for work completed through termination date due within 7 days. Retainer applied to outstanding balance. No refund for unused retainer portion.
Private Courtroom termination: Occurs in cases of non-payment, client misrepresentation, conflict of interest discovery, or scope creep beyond agreed parameters. Fees owed for work completed due within 7 days.
Upon termination, PCR delivers work product completed through termination date. No obligation to complete unfinished analysis.
Intellectual Property
Biological Responsibility Grid (BRG), Neurolegal Paradigm, and all proprietary frameworks remain intellectual property of Private Courtroom.
Reports, analysis, and work product created under engagement agreement are client property upon full payment. Private Courtroom retains right to reference methodologies and anonymized case examples for framework validation and professional publication.
Frameworks, methodologies, and analytical protocols may not be reproduced, adapted, or deployed by client without written authorization.
Confidentiality
Private Courtroom maintains confidentiality of client information, case details, and work product under applicable legal and ethical standards.
Work product operates under attorney work product privilege where applicable. Direct client engagements operate under informed consent with confidentiality obligations defined in agreement.
Confidentiality exceptions: Valid legal subpoenas, court orders, or legal obligations requiring disclosure. Client notified of disclosure requirements where legally permissible.
Conflict of Interest
Private Courtroom declines cases involving conflicts. Prior engagement with opposing parties, personal relationships with case subjects, financial interests in outcomes, or ethical violations result in automatic declination.
Conflict discovered post-engagement results in immediate termination. Fees refunded on pro-rata basis for work not completed.
Limitation of Liability
Forensic analysis based on evidence and data provided by client or investigating authority. Accuracy of conclusions depends on completeness and reliability of source materials.
Private Courtroom (PCR) not liable for case outcomes, verdicts, admissibility rulings, or legal decisions. Consultation supplements legal strategy. Does not replace independent legal counsel.
No guarantee of results. Analysis does not guarantee convictions, acquittals, favorable rulings, or specific outcomes.
Data Retention
Case files retained for seven years following engagement completion. Retention required for potential testimony in appeals or post-conviction proceedings.
Client may request secure destruction of materials after statutory limitation periods expire and all legal proceedings concluded.
Electronic files encrypted and stored on secure servers. Physical materials stored in controlled-access location.
Dispute Resolution
Disputes arising from engagement resolved through binding arbitration under rules of American Arbitration Association.
Arbitration conducted in jurisdiction of Private Courtroom's (PCR) choosing. Prevailing party entitled to recovery of arbitration costs and reasonable attorney fees.
Client waives right to jury trial or class action participation.
Governing Law
Agreement governed by laws of jurisdiction specified in retainer agreement. Jurisdictional choice determined by case location or client jurisdiction.
Modification
Terms of Service may be updated. Changes posted on this page with effective date. Existing engagements governed by terms in effect at time of retainer execution.
